Terms & Conditions
Last updated: October 21, 2026
Agreement to These Terms
These Terms & Conditions (“Terms”) govern your use of the Arizona Commercial Equipment website and your rental of equipment from Arizona Commercial Equipment (“ACE,” “we,” “us,” or “our”), located at 3022 N Maple St, Mesa, AZ 85215. By using this website, submitting a quote request, or renting equipment from us, you agree to these Terms. If you do not agree, do not use the website or our services.
Every rental is also subject to a signed written Rental Agreement. If these Terms conflict with a signed Rental Agreement, the signed Rental Agreement controls.
QuickBooks Integration and Authorized Payments
The QuickBooks integration is an internal business tool for authorized ACE staff, not a public accounting service. Only an authorized representative may connect our business books. Staff must review customer matches, invoice amounts, tax, recipients, and payment authorization before creating or sending invoices or charging a saved payment method. Saving a card does not itself authorize a charge.
QuickBooks and Intuit Payments remain subject to Intuit’s terms, availability, and merchant approval. A sandbox connection does not process real payments. When a transaction’s outcome is uncertain, staff must reconcile its status rather than repeat the charge. Accounting corrections, voids, refunds, and disputes should be handled through QuickBooks or Intuit’s merchant tools; the CRM does not provide direct void or refund controls. Disconnecting the integration does not undo transactions or delete required business records.
For integration support, email service@arizonacommercialequipment.com. Never include passwords, access tokens, full card numbers, or security codes in support requests. These terms and our Privacy Policy describe our practices; they are not a claim of PCI certification or Intuit production approval.
Eligibility & Business Use
Our equipment is rented for commercial and industrial use by businesses and contractors. You represent that you are at least 18 years old, that you have authority to bind the business you identify when requesting a quote, and that all information you provide — including your legal business name — is accurate and complete.
Quotes, Pricing & Availability
- Prices, rates, and totals shown on this website or in an emailed quote are estimates only and are not binding until confirmed by us in writing.
- Quotes are valid for 7 days from the date issued unless otherwise stated, and are subject to equipment availability.
- Submitting a quote request does not reserve equipment. A rental is confirmed only when we confirm it and a signed Rental Agreement is in place.
- Applicable taxes, delivery fees, fuel, cleaning, damage, and late charges may be added as described in your Rental Agreement.
- We may correct pricing errors on the website or in a quote at any time before a rental is confirmed.
Insurance Requirements (COI)
A current Certificate of Insurance (COI) is required for every rental. Your COI must:
- Be issued in the same legal business name you provide when requesting a quote;
- Provide commercial general liability coverage and coverage for rented or leased equipment in amounts we deem adequate for the equipment rented;
- Remain in force for the entire rental period.
We may reject any COI that we determine is insufficient, expired, or inconsistent with the information you provided. If your insurance lapses during a rental, you remain fully responsible for the equipment as described below and in your Rental Agreement.
Payment
- Payment terms, deposits, and accepted payment methods are set out in your Rental Agreement or invoice.
- Rental charges accrue for the entire rental period, whether or not the equipment is used.
- Late or failed payments may result in late fees, suspension of the rental, and repossession of the equipment as permitted by law.
- You are responsible for all reasonable costs of collection, including attorneys’ fees, on past-due amounts.
Delivery, Pickup & Return
- Delivery and pickup times are estimates. We are not liable for delays caused by traffic, weather, site conditions, or other circumstances beyond our reasonable control.
- You must provide safe, lawful, and accessible delivery and pickup locations. Additional charges may apply if a site is inaccessible or unsafe.
- Equipment must be returned (or made available for pickup) on the agreed end date, in the same condition as received, ordinary wear and tear excepted.
- Late returns accrue additional rental charges at the applicable rate until the equipment is returned or recovered.
Use of Equipment
- Equipment may be operated only by trained, qualified personnel, in accordance with the manufacturer’s instructions and all applicable laws, regulations, and safety standards (including OSHA requirements).
- You are responsible for locating and avoiding all underground and overhead utilities, and for obtaining any required permits, before and during use. Always contact Arizona 811 before you dig.
- You may not modify, misuse, overload, sublease, or move the equipment to a different job site without our written consent.
- You must perform routine daily checks (fluids, visible damage, safety devices) and stop using the equipment immediately and notify us if a defect or malfunction appears.
- The equipment remains our property at all times. Nothing in these Terms transfers ownership to you.
Risk of Loss & Damage
From delivery (or pickup by you) until the equipment is returned to us, you bear the entire risk of loss, theft, damage, and destruction of the equipment, regardless of cause or fault. You agree to pay the full repair cost for damage, and the full replacement value for loss, theft, or destruction, plus lost rental income while the equipment is out of service, except to the extent your insurance actually pays us.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Arizona Commercial Equipment and its owners, employees, and agents from and against any and all claims, damages, injuries, losses, liabilities, fines, and expenses (including reasonable attorneys’ fees) arising out of or related to your possession, use, operation, transport, or storage of the equipment, or your breach of these Terms or the Rental Agreement, except to the extent caused by our sole negligence or willful misconduct.
Disclaimer of Warranties
Equipment is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the equipment is suitable for your specific job or site conditions — you are solely responsible for that determination. The website and its content are likewise provided without warranties of any kind, and we do not guarantee the website will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by law, Arizona Commercial Equipment will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost business, project delays, or downtime — arising out of or related to the website, a quote, or a rental, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim will not exceed the total rental charges you actually paid to us for the rental giving rise to the claim.
Cancellations
Cancellation and rescheduling terms, including any applicable fees, are set out in your Rental Agreement or confirmed quote. Please notify us as early as possible if your plans change — the earlier we know, the more flexible we can be.
Website Use & Accounts
- You agree not to misuse the website, interfere with its operation, or attempt to access accounts or systems without authorization.
- If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account.
- All website content — text, images, logos, and branding — is our property or used with permission, and may not be copied or reused without our written consent.
- By submitting a quote request or creating an account, you consent to being contacted by phone, text, and/or email about your inquiry, as described in our Privacy Policy.
Governing Law & Disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms, the website, or a rental will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction and venue of those courts.
General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
- Our failure to enforce any provision is not a waiver of our right to enforce it later.
- You may not assign your rights or obligations under these Terms without our written consent.
- We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the website or our services after changes take effect constitutes acceptance of the updated Terms.
